3.2 Arbitration Agreement

To the fullest extent permitted by applicable law, disputes arising from your use of the Site or Services may be resolved through binding individual arbitration, rather than court litigation.

3.3 Class Action Waiver

You agree that disputes must be resolved individually and not as part of a class action, collective action, or representative proceeding.

3.4 Small Claims Court

Nothing in this section prevents either party from bringing eligible claims in small claims court where permitted by law.

4. LIMITATION OF LIABILITY

The Site and Services are provided on an “as is” and “as available” basis.

To the maximum extent permitted by law:

  • Flowiana makes no guarantees regarding uninterrupted access to the Site.

  • We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

  • Flowiana shall not be liable for indirect, incidental, special, or consequential damages arising from the use of the Site or Services.

If liability is established, our total liability shall not exceed the product subtotal paid for the affected order, excluding delivery fees, service charges, or taxes.

5. PRODUCT & SERVICE DESCRIPTIONS

Floral arrangements are handcrafted and created using seasonal flowers. Because flowers are natural products, variations in size, color, and bloom stage may occur.

Product images represent the overall style and design, but the exact arrangement may vary slightly.

We reserve the right to correct errors, inaccuracies, or omissions and to cancel or modify orders affected by such errors.

6. SUBSTITUTION POLICY

Due to seasonal availability and regional flower supply across Canada and the United States, substitutions may occasionally be necessary.

If substitutions are required, our florists will maintain the overall style, color palette, and value of the arrangement using flowers or containers of equal or greater value whenever possible.

For single-flower arrangements (for example, all-rose bouquets), we will attempt to match the flower type but may substitute a different color or a comparable flower if necessary.

7. DELIVERY POLICY

Flowiana delivers floral arrangements throughout Canada and the United States where delivery service is available.

Delivery Dates

Requested delivery dates represent target delivery windows and cannot always be guaranteed.

Recipient Availability

If the recipient is unavailable at the delivery address, the order may be:

  • left in a safe location,

  • delivered to a neighbor, front desk, or concierge, or

  • rescheduled for the next available delivery date.

Customer Responsibility

Customers are responsible for providing accurate delivery information, including the recipient’s name, address, and phone number.

Flowiana is not responsible for delivery delays caused by:

  • incorrect delivery information

  • restricted building access

  • recipient absence

  • severe weather conditions

  • traffic or logistical limitations

  • high order volumes during major holidays

8. INTELLECTUAL PROPERTY

All content on the Site, including images, designs, text, graphics, logos, and software, is the property of Flowiana.com or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, or exploit Site content without prior written permission.

9. USER CONTENT

If you submit reviews, comments, photos, testimonials, or other content to the Site, you grant Flowiana a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and publish such content for marketing or promotional purposes.

You confirm that any content you submit does not violate third-party rights or applicable laws.

10. PROHIBITED USE

You agree not to:

  • attempt to gain unauthorized access to the Site

  • upload viruses or malicious software

  • scrape or copy website data using automated tools
